This official website is maintained by the claims administrator retained by and under the supervision of Class Counsel and Defense Counsel in the action entitled Brattain et al. v. Richmond State Hospital et al., Cause No. 49D11-0108-CP-1309 (the “Action”), which is pending in the State of Indiana, Marion Superior Court, Civil Division.

On November 10, 2008, the Defendants exercised their option to terminate the settlement pursuant to the terms of the settlement agreement.

Trial took place as scheduled March 10-13, 2009.

The trial court ruled in favor of the plaintiffs on July 28 and awarded $42.4 million dollars. The State has indicated that it intends to appeal the ruling, which could delay the final outcome as much as a year or more. The State will not make any payments until the outcome is final.
